1. Agreement, Scope & Acceptance
​
These Terms & Conditions (Terms) govern your access to and use of Drivers Foundation’s website, mobile and web applications, and the Member Portal powered by the ME Business platform (collectively, the Platform), as well as our events and related services (Services).
​
By accessing or using the Platform — including the Drivers Foundation website and the Drivers Foundation / ME Business app — you acknowledge, accept, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform or the Services.
​
If you create an account or click an acceptance box or similar control, you are deemed to have agreed to these Terms and the Privacy Policy. If you are using the Platform on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms and the Privacy Policy.
​
We may update these Terms from time to time. Continued use after an update constitutes acceptance of the updated Terms. To the extent of any inconsistency between these Terms and the Privacy Policy with respect to privacy matters, the Privacy Policy prevails.

2. Definitions

Member: a person with an active Drivers Foundation membership.

Portal: the Member Portal powered by the ME Business platform.

Events: drives, social meets, track days, and other activities organised or supported by us.

Partner: a third party we work with (e.g., insurers, venues, car care providers).

Platform: the Drivers Foundation website and the Drivers Foundation / ME Business app (including the Portal).

You: the individual accessing the Services, or the legal entity you represent.

3. Eligibility & Accounts
​

You must be at least 18 years old and legally capable of entering into contracts.

You must provide accurate and up-to-date information and keep your login credentials secure.

You are responsible for all activity under your account and must notify us promptly of any unauthorised use.
​
4. Memberships, Fees & Renewals
​
We may offer membership tiers (e.g., Supporter, Driver, Founder) with different benefits, which may change over time.
Fees are shown at checkout in the Portal and are payable in AUD (inclusive of GST where applicable).
Renewals: where enabled, memberships may auto-renew at the then-current price unless you cancel before the renewal date.

Transfers & sharing: memberships are personal and non-transferable unless expressly permitted.
Refunds: we comply with Australian Consumer Law (ACL). Otherwise, membership fees are non-refundable once the term begins, except where required by law.

4A. Membership Approval & Review Process
​
All membership applications are subject to review and approval by Drivers Foundation (or its appointed Membership Panel).
​
Submission of an application form and/or payment of membership fees does not automatically grant membership.
Membership will only be activated once the application has been formally reviewed and approved by Drivers Foundation.
​
We reserve the right to request additional information or to decline any membership application at our sole discretion, including where the applicant’s conduct, background, or affiliations are inconsistent with the values or reputation of Drivers Foundation.
​
If an application is declined, any payment received will be refunded in full within a reasonable time frame.
Drivers Foundation is not obligated to provide reasons for declining an application.
​
5. Events & Activities
​
Compliance: you must hold any required licence, obey road/track rules, and follow organiser instructions at all times.
Vehicle condition: you are responsible for ensuring your vehicle is safe, roadworthy, and suitable for the activity.
​
Safety: motorsport and driving activities carry inherent risks of injury or damage. Participation is voluntary and at your own risk.
​
Alcohol/drugs: zero tolerance for driving under the influence. We may refuse participation or remove you from an Event.
​
Weather & changes: we may modify, postpone, or cancel an Event where safety or operational concerns arise (e.g., severe weather, venue issues).
​
Waiver: As a condition of participating in any driving or track Event, you agree to sign any required venue/organiser waiver and release. If you do not agree, you must not participate.
​
6. Health, Safety & Fitness
​
By participating in any Event, you confirm that you are medically and physically fit to do so and that you accept full responsibility for assessing your own ability to participate safely.
​
Drivers Foundation and its affiliates are not liable for any health-related incidents or injuries unless directly caused by our negligence.
​
7. Vehicle Compliance & Responsibility
​
You are solely responsible for ensuring that your vehicle complies with all applicable laws, including registration, emissions, and modifications.
​
Drivers Foundation is not liable for fines, penalties, or mechanical failures arising from your vehicle’s condition or modifications.
​
8. Insurance (Information Only & Participant Responsibility)
​
Drivers Foundation is not an insurer and does not provide insurance of any kind.
​
Where we facilitate insurance enquiries or applications, coverage is subject to the insurer’s own underwriting criteria and Product Disclosure Statement (PDS). Nothing in our Services constitutes personal financial product advice.
​
Track and Drive Day Insurance: Participation in any driving, track, or motorsport-related activity is undertaken entirely at your own risk.
​
It is your sole responsibility to obtain any insurance you consider appropriate (including track-day vehicle damage cover, personal accident insurance, or third-party liability cover).
​
Drivers Foundation, its officers, volunteers, organisers, sponsors, and venue owners do not provide, arrange, or accept liability for any insurance coverage for vehicles, property, or participants.
​
By registering or attending a track or drive day, you acknowledge that neither Drivers Foundation nor the track operator or event organiser is liable for any loss, damage, or injury except where required by law.
​
Policy documents and communications facilitated through the Portal may be stored for your convenience, but Drivers Foundation accepts no responsibility for the accuracy or completeness of any insurance product or information.
​
9. Club Permit (Victoria)
​
We assist Members with documentation and membership verification for the VicRoads Club Permit Scheme but are not VicRoads and do not issue permits.
​
Eligibility, roadworthiness, and compliance remain your responsibility. Providing false or misleading information may result in rejection or cancellation.
​
You authorise us to share necessary information with VicRoads or related authorities for the purpose of processing your Club Permit request.
​
By applying for or maintaining a Club Permit through Drivers Foundation, you acknowledge and agree to comply with all VicRoads guidelines and all applicable state and federal laws relating to the operation and maintenance of vehicles under the Club Permit Scheme.
​
You further indemnify Drivers Foundation, its officers, and volunteers against any claims, penalties, losses, or liabilities arising from your failure to comply with such requirements, including but not limited to misuse of the Club Permit, breaches of road law, or vehicle non-compliance.
​
Drivers Foundation accepts no responsibility for any administrative or legal outcomes resulting from a Member’s breach of VicRoads or related regulations.
​
10. Privacy & Data Protection
​
Drivers Foundation complies with the Privacy Act 1988 (Cth). Personal information collected through memberships, events, or the Platform will only be used for legitimate Foundation operations and not sold or shared except as required by law or with your consent.
​
By using our Services, you consent to this collection and use.
​
11. Website & Platform Disclaimer
​
The content on our website, app, and promotional materials is provided for general information only.
​
While we make reasonable efforts to ensure accuracy, Drivers Foundation makes no representations or warranties about completeness, reliability, or suitability for any purpose. Use of this information is at your own risk.
​
12. Copyright & Take-Down
​
If you believe any material on our platforms infringes your intellectual-property rights, please notify us at info@driversfoundation.au with details of the alleged infringement.
​
We will investigate promptly and remove or disable access to infringing content where appropriate.
​
13. Complaints Handling
​
Members may raise concerns or complaints regarding services, memberships, or events by emailing info@driversfoundation.au.
​
We will aim to respond within 14 days. If unresolved, disputes proceed to mediation as set out in Section 33.
​
14. Constitutional Precedence
​
Where applicable, the Constitution of Drivers Foundation (ABN 22 690 339 407) governs the internal management of the organisation.
​
In the event of any inconsistency between these Terms and the Constitution, the Constitution prevails.
​
15. Third-party Services & Links
​
Our Services integrate with third-party platforms (e.g., the ME Business platform for the Portal, payment processors, social embeds).
​
We are not responsible for third-party services, which are governed by their own terms and privacy policies.
​
16. Third-party Referrals, Sponsors & Offers Disclaimer
​
From time to time, we may refer, promote, or provide access through our website, app, or events to third-party services, offers, sponsors, or partners — including but not limited to insurance providers, automotive businesses, and product or service suppliers.
​
While we may facilitate introductions or display discounts or offers negotiated on behalf of our Members, Drivers Foundation does not act as an agent, representative, or guarantor for any third-party organisation or provider. All dealings, communications, and transactions you enter into with any third party are strictly between you and that third party.
​
To the fullest extent permitted by law: Drivers Foundation is not responsible for the performance, quality, suitability, accuracy, or delivery of any third-party product, service, or offer; we do not warrant or endorse any third party; and we do not accept any liability for loss, damage, claim, or expense arising from or connected with third-party dealings, products, or workmanship.

Any discounts or benefits offered to Members are provided solely as a goodwill arrangement. Responsibility for honouring, delivering, or maintaining such offers remains entirely with the third party.
​
Members are encouraged to perform their own due diligence and to review the third party’s terms, conditions, and policies before engaging with them.
​
Nothing in this clause limits any rights you may have under the Australian Consumer Law in relation to goods or services provided directly by Drivers Foundation.
​
17. Photography & Media Use
​
By attending our Events, you grant Drivers Foundation a perpetual, worldwide licence to use your likeness in photos or videos for promotional purposes.
​
You may withdraw consent by notifying us in writing prior to the Event, though we cannot remove materials already published.
​
18. Data Security, Digital Conduct & Platform Availability
​
You must not attempt to copy, reverse-engineer, or interfere with any part of the Platform.
​
We use reasonable technical safeguards to protect your data; however, no system is completely secure, and we cannot guarantee absolute protection from unauthorised access.
​
While we strive to maintain continuous access to the Platform, we do not guarantee uninterrupted or error-free operation. Maintenance, system failures, or external disruptions may occasionally affect availability, and Drivers Foundation will not be liable for any resulting loss or inconvenience.
​
19. Environmental & Legal Compliance
​
Drivers Foundation promotes safe, lawful, and environmentally responsible driving. All participants must comply with applicable road, environmental, and noise regulations at all times.
​
20. Force Majeure
​
Drivers Foundation is not liable for any delay or failure in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, government restrictions, or acts of third parties.
​
21. Refunds & Event Cancellation
​
If an Event is postponed due to circumstances beyond our control, tickets will automatically transfer to the rescheduled date.
​
Refunds will only be provided where cancellation occurs without a rescheduled date or where required under the Australian Consumer Law.
​
22. Volunteer, Director & Partner Liability
​
To the extent permitted by law, Drivers Foundation, its directors, officers, employees, and volunteers are not personally liable for any loss, damage, or injury suffered by any person arising from or in connection with any activity, event, or service provided by Drivers Foundation, except where caused by proven negligence.
Members and participants expressly release and indemnify each of them from all such claims, liabilities, and expenses.

22A. Donations & Charitable Contributions
​
Drivers Foundation supports various charitable causes and may donate a portion of proceeds from memberships, events, merchandise, or sponsorship activities to selected charities or community programs.
​
Unless otherwise specified, donations are made at the discretion of Drivers Foundation and may vary depending on operational needs, fundraising outcomes, or other factors.
​
We reserve the right to change, replace, or discontinue any nominated charitable partner or initiative at any time without notice.
​
Any advertised percentage or amount designated for donation (e.g., “5% of proceeds”) will be calculated after the deduction of applicable taxes, transaction fees, and operational costs.
​
Drivers Foundation is not a registered charity but may collaborate with registered charitable organisations for the purpose of fundraising or awareness campaigns.
​
Nothing in these Terms creates any entitlement by Members or participants to a specific donation or allocation of funds.
​
Where an Event is promoted as a fundraiser or charity event, details of the beneficiary charity and estimated donation amount will be provided in event marketing materials or upon request.
​
23. Risk Acknowledgement & Waiver
​
By attending or participating in any Drivers Foundation event or activity, you acknowledge that driving and motorsport activities are inherently dangerous and involve risk of injury, death, or property damage.
​
You voluntarily accept all such risks and agree that Drivers Foundation, its directors, officers, volunteers, sponsors, and event partners are not liable for any injury, loss, or damage arising from participation except where required by law.
​
24. Member Indemnity
​
You agree to indemnify and hold harmless Drivers Foundation, its directors, officers, employees, agents, and volunteers from and against any claims, damages, costs, or liabilities (including legal fees) arising from your breach of these Terms, your negligence, or your misconduct at any Drivers Foundation event or activity.
​
25. Compliance with Laws
​
Members and participants must comply with all applicable laws and regulations, including traffic laws, motor vehicle standards, and venue or council regulations.
Drivers Foundation will not be responsible for any penalties, fines, or legal consequences arising from a participant’s non-compliance.
​
26. Notices
​
Any notices or communications may be sent electronically via email, the Portal, or other reasonable digital means.
Notices are deemed received when sent, not when opened.
​
27. Membership Termination for Cause
​
Drivers Foundation reserves the right to revoke or refuse membership or event participation if a Member’s conduct, criminal record, or public behaviour is deemed inconsistent with the Foundation’s values or likely to damage its reputation.
​
28. Warranty Disclaimer
​
To the maximum extent permitted by law, the Services are provided on an “as-is” and “as-available” basis.
​
We disclaim all warranties not expressly set out in these Terms. Nothing in these Terms excludes, restricts or modifies any consumer guarantees under the ACL that cannot be excluded.
29. Liability & Indemnity
​
Nothing in these Terms limits your rights under the ACL or our liability for negligence where such limitation would be unlawful.
​
Subject to the ACL, we are not liable for indirect, incidental, special or consequential loss, loss of profits, or loss of opportunity.
​
Event risk: you acknowledge the inherent risks in driving and motorsport activities and agree, to the fullest extent permitted by law, to release and indemnify us, our officers, volunteers and partners from claims arising out of your participation where we are not negligent.
​
30. Changes to Services & Terms
​
We may update the Services and these Terms from time to time. Updated Terms will be posted on our website with a new 'Last updated' date.
​
If a change materially affects paid memberships, we will provide reasonable notice by email or in the Portal.
​
31. Suspension & Termination
​
We may suspend or terminate access if you breach these Terms, for safety or security reasons, or where required by law.
​
You may cancel your membership at any time via the Portal (refunds subject to ACL and clause 4).
​
32. Severability, Non-Waiver & Entire Agreement
​
If any provision of these Terms is found to be invalid or unenforceable, that part shall be interpreted to reflect the parties’ original intent, and the remaining provisions will remain in full force.
​
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.
These Terms constitute the entire agreement between Drivers Foundation and you regarding the Services.
​
33. Dispute Resolution & Governing Law
​
All disputes must first be submitted to good-faith mediation in Melbourne, Victoria, before proceeding to court. Mediation will be conducted under the rules of the Resolution Institute of Australia.
​
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
